Vraag en antwoord

Approval of the Works Council is needed if there is a change in one of the regulations on the subjects mentioned in Art. 27 of the Dutch Works Council Law.

The measures to make the opening of your company possible, are likely to be temporary. Therefor a change of regulations is most probably not applicable and approval of the Works Council is not needed.

Good to know: many company boards involve their Works Council in determining Covid-19 measures even if involvement is not required. Because there is a lot of uncertainty among employees, the involvement of the Works Council can help to reduce uncertainty and can ensure that measures match the needs of the employees. Perhaps you can convince the management to therefore consult with you about intended measures.
